TERMS OF SERVICE AND LIABILITY WAIVER
PLEASE READ CAREFULLY BEFORE PURCHASING
I. Acknowledgment of Services
By purchasing a Rally Vision video package, I acknowledge and agree that The Rally Spot LLC, doing business as Rally Vision (“Rally Vision””), in collaboration with Pickleball Vision AI Inc. (“PBVision”), will provide mobile video recording and upload services at designated pickleball tournaments. Game footage will be uploaded to PBVision’s platform for game replay and player analytics. I understand that I will not need a subscription to PBVision, but I will need to create an account to access the content. I consent to this process and understand that access to my recordings and analytics is subject to PBVision’s terms.
II. Consent to Record and Use of Likeness
I consent to being recorded during gameplay and authorize Rally Vision and its affiliates to record, upload, reproduce, distribute, publicly display, and create derivative works from such recordings. This includes the use of my name, image, voice, and performance in any media now known or later developed. I waive any right to inspect or approve the use of such materials and understand that I will not receive compensation for any such use. I further understand that Rally Vision is not required to provide recordings to any third party and will only release footage to the purchasing customer or as required by law. Rally Vision may decline requests for footage from non-customers without explanation. Rally Vision may also share a limited selection of non customer specific highlight clips or raw game recordings with official event partners for promotional purposes, provided that (a) they do not include footage from customers who have opted out of sharing, and (b) partners do not receive access to full match libraries or customer purchased recordings or analytics on PBVision.
III. Limitations
I acknowledge that technical issues such as equipment malfunctions, software problems, or connectivity failures may affect video quality or availability. I understand that if other participants in a game do not consent to being recorded, those games may not be uploaded. I accept these limitations and release Rally Vision from liability for circumstances outside of its reasonable control. I also acknowledge that injury stoppages, disputes, delays, incomplete games, unsafe conditions, or other unexpected events may result in partial or unusable footage. Rally Vision will not be liable for any failure to capture or complete footage caused by these circumstances.
IV. Refund Policy
I agree to notify Rally Vision by email or in writing of any missing, incomplete, incorrect or defective videos within 14 days of the event date (“Claim Period”).
Within the Claim Period Rally Vision will use commercially reasonable efforts to remedy the issue for the Customer. If Rally Vision is unable to remedy the issue Rally Vision, in its sole discretion, may offer a full refund, partial refund, or other compensation to Customer.
After the Claim Period, all video content will be deemed accepted and final. Rally Vision may permanently delete all raw video files and related project data following this period, and no refunds, credits, or redeliveries will be issued.
V. Event Cancellation or Changes
If the event is canceled and not rescheduled, Rally Vision will issue a full refund. If the event is rescheduled and Rally Vision can provide services on the new date, the package you purchased will carry over to the new event. If the venue or date changes and Rally Vision can not support the revised logistics, Rally Vision will issue a full refund. Rally Vision will not be responsible for changes, delays, or modifications made by tournament organizers or venues.
VI. Participation by Minors
If the purchaser is under 18, a parent or legal guardian must accept these terms on their behalf. By proceeding with the purchase, the parent or guardian confirms they have the legal authority to do so and consents to the minor being recorded and included in PBVision’s platform.
VII. Governing Law
These terms are governed by the laws of the State of California. Any disputes will be resolved exclusively in the courts located in Los Angeles County, California.

IX. Release of Liability
I release and hold harmless Rally Vision, its officers, agents, employees, sponsors, PBVision, tournament organizers, venue owners, and all affiliated parties (“Releasees”) from any claims or damages related to the video services, including missed footage or technical failures. This release applies to the fullest extent permitted by law, whether or not caused by the negligence of any Releasees. This release includes any claims arising from arguments, disputes, altercations, player or spectator conduct, third party demands for footage, or Rally Vision’s decision not to share, upload, or deliver certain recordings.
X. Rally Vision Discretion Regarding Footage
Rally Vision retains full discretion to withhold, delay, edit, or decline to upload footage if a match is interrupted, substantially delayed, affected by a dispute or altercation, presents safety concerns, or becomes the subject of a request from a tournament provider or venue not to release certain recordings. In such cases, Rally Vision will be deemed to have performed its obligations by making reasonable efforts to provide any available footage and will not be liable for declining to deliver footage under this section. Refunds will only be provided as allowed under the Refund Policy.
XI. Acknowledgment and Agreement
By purchasing this package, I confirm that I have read and understood these terms, including the refund policy, risks, and limitations. I agree to these terms voluntarily and without inducement and acknowledge that I am waiving substantial legal rights by accepting them.
